Marc Weinstein

Mr. Weinstein has been a practicing attorney for nearly 25 years.  In that time, he has developed a broad-based expertise across all aspects of patent law with a focus on post-grant proceedings, litigation, licensing, and IP counseling.  He serves as local counsel in the district court for the Eastern District of Virginia.

Since the inception of the AIA, Mr. Weinstein has been involved in dozens of Inter Partes Reviews (IPRs) and Post Grant Reviews (PGRs) representing both patent owners and petitioners across a variety of technological areas including GPS and navigation, cellular communication, imaging and displays, oil and gas extraction, motors, and computer software.  He also has extensive experience with ex parte reexaminations and reissue applications.

In addition to post-grant proceedings, Mr. Weinstein has worked on numerous patent infringement litigations, both at the U.S. District Court and at the International Trade Commission (ITC).  His experience involves every phase of litigation including preparing complaints and answers, taking and defending depositions, conducting all aspects of discovery, and drafting motions and briefs.

Mr. Weinstein also has abundant experience in license negotiations representing both licensors and licensees.  Those negotiations have resulted in tens of millions of dollars of licensing fees for his clients as well as multiple favorable cross-licenses when representing clients against their competitors.

Having lived and worked in Tokyo for over 10 years, Mr. Weinstein has extensive experience working with Japanese clients. During his time in Japan, he worked closely with Japanese clients on a variety of matters including strategic prosecution, opinions, licensing, patent litigation and post-grant proceedings.

Marc obtained his undergraduate degree in electrical engineering from Pennsylvania State University and his juris doctorate degree from the Georgetown University Law Center.  Mr. Weinstein is also a former patent examiner at the USPTO, where he examined patent applications related to I/O processing and multi-computer architectures.
